However, Finan asserts that the lyrics were recorded in January 2022, seven months prior to the shooting, thereby undermining the prosecution’s narrative.

The motion argues that the grand jury was misled by the government’s assertions, which included the erroneous claim that the lyrics were altered to include audio from a news clip featuring a distressed individual reacting to a murder scene. Finan states that the government failed to investigate the origins of the song thoroughly, neglecting to verify the timeline of its creation or the authenticity of the audio clips it presented as evidence.

The defense maintains that the inclusion of these lyrics in the indictment is a critical element that swayed the grand jury’s decision to indict Lil Durk.
